These Terms & Conditions (“Terms”) govern your access to and use of (a) marina facilities, docks, slips, services, and amenities, and (b) websites, online tools, and digital platforms (collectively, the “Services”) operated by TopSide Marinas and its affiliated marina locations (each, a “Marina”). These Terms apply only to users located in the United States. By accessing or using any Marina facility or website, you agree to these Terms.

1.  Marina-Specific Application

TopSide Marinas operates and manages multiple marina locations. Each Marina may maintain location-specific rules, rates, agreements, waivers, and posted policies.In the event of a conflict, Marina-specific agreements, waivers, or posted rules shall control.

2.  User Eligibility

Use of Marina facilities is subject to:• All posted rules, safety requirements, and applicable laws• Safe and responsible vessel operation• Proper use of docks, slips, fueling systems, electrical hookups, and waste facilitiesThe Marina reserves the right to refuse service, suspend access, or require removal of any person or vessel for safety concerns, non-payment, or rule violations.

4.  Assumption of Risk & Waivers

Marina activities involve inherent risks, including but not limited to water conditions, weather, vessel movement, equipment operation, and interaction with other vessels and guests.By using Marina facilities or participating in Marina activities, you:• Acknowledge and assume all inherent risks, and• Agree to comply with any separate waivers or releases of liability required by a specific Marina, service, event, or activityExecution of a Marina-specific waiver does not limit the applicability of these Terms.

5.  Vessel Responsibility & Insurance

All vessels and personal property are brought onto Marina property at the owner’s sole risk.Unless expressly stated otherwise in writing:• The Marina does not provide insurance coverage for vessels, equipment, or personal property• Vessel owners are responsible for maintaining adequate insurance, including liability coverageThe Marina may require proof of insurance as a condition of service.

6.  Reservations, Payments & Transactions

Reservations, slip rentals, storage, and other services may be booked online or in person and are subject to:• Marina-specific rates and availability• Payment, deposit, cancellation, and refund policiesFailure to pay required charges may result in cancellation, service suspension, or vessel removal, as permitted by law.

7.  Website & Digital Services

Marina websites and digital tools are provided “as is” and “as available.” We do not guarantee:• Continuous or uninterrupted access• Accuracy or completeness of online content, rates, or availabilityWe may modify or discontinue website features or online services at any time without notice.

You agree to use the Website and services only for lawful purposes and in compliance with these Terms and applicable laws.
